On Wednesday, the Texas House of Representatives is voting on HB 366 — a bill that strikes at the heart of free political expression in Texas.
HB 366 would hand the government the power to police Texans’ speech. Instead of voters judging political messages, government officials would decide what’s acceptable — a direct assault on the First Amendment, which protects the right of the people, not state censors, to evaluate political debate.
The bill would criminalize sharing political content — including images, video, or audio — if the government believes it didn’t “occur in reality,” unless it's branded with a government-approved disclaimer. Spend just $100 on political messaging, and you could be subject to fines or even jail time.
Under HB 366, Texans could face fines — or even jail time — simply for sharing images of government officials that the government claims "did not occur in reality." That means ads, mailers, videos, memes, and even lighthearted political commentary like a cartoon or AI-generated image could land you in legal trouble.
And it gets worse:
Political speech that offends or challenges public officials should be met with more speech, not handcuffs. HB 366 would chill political debate and open the door to government-controlled narratives.
